Terms of service
The agreement between you and 9jaCycle when you buy, sell or chat here. Plain words on purpose: if something below is unclear, that is our fault, and you can ask.
1. Who you are agreeing with
9jaCycle is a trading name of THE WILSBAY LIMITED (RC 9955075), a company registered in Nigeria, at Lakeview Park, Orchid Road, Lekki Phase 2, Lagos, Nigeria. By creating an account or using 9jaCycle you agree to these terms and to our privacy policy. Questions go to hello@9jacycle.com.
2. Who can join
- You must be 16 or over. If you are 16 or 17, you may use 9jaCycle only if a parent or guardian agrees, and they are responsible for your use of it, including anything involving money. We ask your age when you join and before your first purchase, sale, offer or withdrawal.
- One account per person, on a Nigerian phone number that is yours. You sign in with a code we text to it, so keep your phone and its codes to yourself: you are responsible for what happens on your account.
- Tell the truth about yourself and your items. Pretending to be someone else, or another business, is not allowed.
3. What we do, and what we don't
9jaCycle is a marketplace. The contract for an item is between the buyer and the seller: we are not the seller, we have not inspected the item, and we never own it.
What we do is hold the money in the middle. The buyer pays us, we hold the payment in escrow while the item is on its way, and the seller is paid once the buyer confirms it arrived or the time to report a problem runs out. Card and bank payments are processed by Paystack; we never see or store card details.
We are not a bank or an insurer, and money in your 9jaCycle wallet earns no interest. Our fees pay for holding the money and for a person to settle disputes. They are not insurance.
4. Fees
- Buyers pay a buyer protection fee of 2%, at least ₦150, at most ₦5,000 per order, shown with the item and delivery before you pay. Nothing is added afterwards.
- Sellers pay a fee of 2%, at most ₦5,000 of the item price per order, taken when the money is released to them. Listing is free. There is no fee on delivery.
- Each order keeps the fees it was placed with. If we change our fees, the new ones apply to orders placed afterwards, and we give notice as set out in section 16.
5. Buying
- Pay only through 9jaCycle. A payment made any other way is outside these terms and outside our protection, and we cannot get it back for you.
- Once you pay, the seller has 5 days to send the item. If they don’t, the order cancels itself and you are refunded in full.
- When the item arrives, tell us. You then have 48 hours to confirm it is what was described or to report a problem. If you do neither, the order completes on its own and the seller is paid.
- If the seller reports the item delivered and you don’t have it, tap “I haven’t received it” on the order straight away: the money stays held while a person looks into it. If an order has been on its way 5 days without either of you saying it arrived, we ask you.
- Where a seller offers collection, you can meet them instead of paying for delivery. The money is still held, and you complete the order by giving the seller your handover code once you have checked the item. Meet somewhere public.
- Once an order completes, the payment cannot be pulled back by us. Escrow protects the gap between paying and receiving, and that gap closes when you confirm or the window ends.
- Refunds go back to how you paid. Banks usually show them within a few working days, though some take longer; we can show you the reference if yours is slow.
The details are on buyer protection.
6. Offers
- Buyers can offer below the asking price, from 50% of it, unless the seller has turned offers off for that item. A seller can also set a private lowest price; an offer under it is refused without the figure being shown.
- An offer, a counter-offer or a price the seller sends in chat lasts 48 hours. An accepted price is for that buyer only, until those hours run out. Accepting an offer is not a sale: the item sells to whoever pays first.
7. Selling
- List only what you own and have the right to sell, with your own photos of the actual item and an honest description, including any wear or fault. The item you send must be the one in the listing.
- Choose the condition that is true. These are the conditions and what each means:
- New with tags — Never used, original tags or packaging still on.
- New — Never used, no tags or packaging.
- Very good — Barely used, no visible flaws.
- Good — Used, with light wear worth mentioning.
- Fair — Well used, with flaws described and shown.
- For parts / not working — Doesn't work as it should. Sold for repair or spare parts.
- Phones, tablets and laptops must say what is faulty (or that nothing is), what has been repaired or replaced, and the battery health. You may add the IMEI or serial number; buyers see only its last 4 characters. Leaving out a fault you knew about is grounds for a refund.
- Prices run from ₦500 to ₦20,000,000. A sale price must be a real cut from a price that stood for at least 7 days, and no more than 70% off.
- Send the item within 5 days of payment, with a rider you book, and add the rider’s number when you mark it sent. The delivery fee the buyer paid comes to you for the ride. If you miss the deadline, the order cancels and the buyer is refunded.
- If the buyer goes quiet after delivery, you can report it delivered with a photo, which starts their 48 hours. A silent buyer cannot strand your money.
The details are on selling and getting paid.
8. Getting paid
- Money from a sale reaches your wallet when the order completes, less our fee. You can withdraw to your bank account once your balance is at least ₦1,000.
- Payouts go only to a bank account in your own name. Before your first withdrawal we ask your legal name and check it against the name the bank holds for the account. If they don’t match, the payout waits until you fix it or our team confirms the account is yours.
- A newly added or changed bank account waits 24 hours before money can be sent to it, and we text you when it changes and when you withdraw, so a stranger with your phone cannot quietly empty your wallet.
- We may ask sellers to verify their identity in future. We will tell you before we do.
9. When something goes wrong
A buyer can report a problem from the moment the item is on its way until the 48-hour window closes. From then, the money stays where it is until the matter is settled.
- The seller is told at once and has 48 hours to give their side, with photos. Both sides’ photos and the chat are in front of whoever decides.
- A person at 9jaCycle decides, aiming to do so within 3 working days. There are four possible outcomes: refund the buyer in full; refund part of it, buyer keeps the item; buyer returns it, then gets a refund; no refund — pay the seller. Both sides are told the decision and the reason.
- Either side may appeal once, within 7 days, saying why the decision is wrong. Someone else on our team looks again and their decision is final. The money moves only when the appeal window closes, or sooner if both sides accept the decision.
- If the decision is a return, the buyer has 5 days to send the item back, or the seller is paid. The seller then has 3 days to confirm what came back; if they say nothing, the buyer is refunded. The refund is never sent before the item is on its way back. On a return, the buyer is refunded everything, including delivery.
- A partial refund comes from the item price and our fee, never the delivery, which was already done.
Each step is set out on when something goes wrong. By using 9jaCycle you agree to settle problems with an order this way first. It does not take away any right you have under the Federal Competition and Consumer Protection Act 2018 or any other law.
10. Card disputes
If a buyer asks their bank to reverse a card payment instead of using the dispute process, the money for that order is frozen until the bank decides. If the seller has already been paid, that amount is held back from their withdrawals meanwhile, and they are told. If the bank sides with the buyer, the seller’s share comes back out of their wallet. Using a bank reversal to get an item for free is fraud, and ends in suspension.
11. Keep it on 9jaCycle
Phone numbers, account numbers, emails, links and social handles are hidden in chat, in both directions. Don’t try to get around that, and don’t ask anyone to pay or meet outside 9jaCycle to avoid the fees: it is how people lose money, and it can end in suspension. Once an order is paid, the delivery details each side needs are shown on the order itself.
After an order completes, the buyer and seller can keep chatting for 7 days for questions about the item. Then the conversation becomes read-only. When an item sells, other buyers’ conversations about it close.
12. What can't be sold
- Vehicles and property — not sold on 9jaCycle yet
- Fakes, replicas and anything counterfeit
- Anything stolen, or that you do not have the right to sell
- Weapons, ammunition, explosives and parts for them
- Drugs, medicines that need a prescription, and drug equipment
- Alcohol and tobacco, including vapes
- Adult and sexual content
- Live animals — the Pets section is for accessories, food and bedding only
- Recalled, unsafe or expired goods
- Personal data, accounts, gift cards and anything that is really money
- Anything illegal to own or sell in Nigeria
We remove listings that break this, and repeated or serious breaches end in suspension. Where the law requires it, we pass information to the police or a regulator.
13. Reviews and behaviour
Only the buyer and seller on a completed order can review each other, once each. Reviews must be honest and about that order. Harassment, scams, threats, fake reviews and misleading listings are not allowed; foul language in chat is hidden from the reader. Anyone can report a listing, a member or a message, and a person reads every report.
14. Suspension
We may remove a listing, withhold a seller badge, or suspend an account that breaks these terms, and we tell you why. A suspended account cannot list, buy, make offers, start or send messages, or withdraw, and its items come off the shop. Orders already paid for carry on to the end, so nobody else’s money is stranded.
Money in a suspended member’s wallet stays theirs. Once it is not tied to an open dispute or to the reason for the suspension, our team can pay it to their own bank account. To appeal a suspension, email hello@9jacycle.com; a person reads every appeal and replies. See if your account is suspended.
15. Your account and your content
We tell you when someone signs in to your account, when your bank account changes, and when money is withdrawn. If it wasn’t you, sign out everywhere from Account, then Security, and email us.
What you post stays yours. You give us permission to show it on 9jaCycle, to resize it, and to show it in search engines while it is live. We compare photos with others on 9jaCycle to catch pictures reused by someone else, and we may hold a listing for a person to check before it goes live.
You can delete your account at any time from Account, except while there is an order that is still open, or a withdrawal on its way to your bank, or money left in your wallet. What is removed and what is kept is on delete your account. We may close an account that has seriously broken these terms, after seeing any open orders through.
16. Changes to these terms
We will give at least 14 days’ notice of any change to these terms, by a notification in the app and a notice on this website and in the app, saying what is changing and when. From that date we will ask you to accept the new terms before you next buy, sell, make an offer or withdraw. If you don’t want to, you can stop using 9jaCycle and delete your account. Orders already paid for stay under the terms they were placed under.
17. What we are responsible for
We are responsible for holding payments safely, for following the steps on our help pages, and for deciding disputes fairly. We are not responsible for what a seller says about an item, for an item’s quality beyond what the dispute process puts right, or for anything arranged outside 9jaCycle.
For any one order, the most we will pay you is the amount you paid on that order. We are not liable for indirect losses, such as lost profit. Nothing here limits our responsibility where the law does not allow it to be limited, including for fraud or for harm caused by our own negligence.
We work to keep 9jaCycle running, but it may sometimes be slow or unavailable. If an outage stopped you meeting a deadline on an order, write to us and a person will look at it.
18. Complaints and law
A complaint about us, rather than about an order, goes to hello@9jacycle.com. We reply to every one. If you are not satisfied, you can contact the Federal Competition and Consumer Protection Commission.
These terms are governed by the laws of the Federal Republic of Nigeria. If a disagreement with us cannot be settled by writing to us, it goes to the courts of Lagos State.
